These terms and conditions (the “Terms and Conditions”) govern all the use of Bauxite Price Index Calculator Application (the “BPI Calc”) service, the Website (www.thebauxiteindex.com) and other online properties. Together the Website, the mobile App, the desktop App and other online properties are referred to as “the service” “BPI Calc”. The service is owned and operated by The CM Group.net Pty Ltd (the “CM Group” or “we”), the service is intended for and written only for sophisticated, professional, institutional and highly experienced industry participants. By using the service, you indicate that you have read and understand these Terms and Conditions and agree to always abide by them.

Intellectual Property
The works of authorship contained in BPI Calc including but not limited to all design, text, sound recordings, and images are owned, except as otherwise expressly stated, by CM Group or one of its subsidiaries. Except as otherwise expressly stated herein, they may not be copied, transmitted, displayed, performed, distributed (for compensation or otherwise), licensed, altered, framed, stored for subsequent use, or otherwise used in whole or in part in any manner without CM Group’s prior written consent.
CM Group hereby grants you a limited, non-exclusive, non-transferable, revocable license for the term hereof to access and download, display, and print one copy of the BPI Calc Content solely for your internal, business use, provided that you do not modify the Site Content in any way (including creating derivative works thereof), that you retain all copyright and other proprietary notices displayed on the BPI Calc Content, and that you otherwise comply with these Terms. You may not otherwise reproduce, modify, reverse engineer, distribute, transmit, post, or disclose the Content without CM Group’s prior written consent. In addition, you may not “mirror” the Content or any portion thereof without CM Group’s express written consent. Nothing in BPI Calc should be construed as granting directly or indirectly, or by implication any license or right to use any CM Group intellectual property other than as expressly set forth herein. The license granted in this section terminates automatically and immediately if you do not comply with these Terms.
Age Restrictions
The minimum age to use the service is 18 years old. By using the service, users agree that they are over 18 years old. We do not assume any legal responsibility for false statements about age.
Acceptable Use
As a user of the service, you agree to use the service legally, not for illegal purposes, and not to:

When you create an account on BPI Calc, you agree to the following:
(i) You are solely responsible for your account and the security and privacy of your account including passwords or sensitive information attached to that account; and
(ii) All personal information you provide to us through your account up to date, accurate, and truthful and that you will update your personal information if it changes.
We reserve the right to suspend or terminate your account if you are using BPI Calc illegally or if you violate these Terms and Conditions.
Content And Materials
The information on the service is for information purposes only. It is believed to be reliable, but BPI Calc does not warrant its completeness, timeliness or accuracy. The service publications, including our research and commentary, are not intended for retail or inexperienced investors. Although the information on the service is designed for, and intended for sophisticated, professional and highly experienced investors, any advice that may be contained in them is general advice that has not been tailored or directed to any particular such investor.

- BPI Basic Calculator – indicative and quick estimation tool for your price assessment.
- BPI Pro Calculator – detailed value-in-use analytical tool for a more accurate assessment on given bauxite grades.
- Subscription to the Bauxite Index.
The services will be paid for in full when the services are ordered. We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.
By subscribing to BPI Calc, you agree that:
(i) you will not engage in any activities related to BPI Calc that are contrary to applicable law, regulation or the terms of any agreements you have with BPI Calc, and
(ii) in circumstances where locations of t BPI Calc require identification for access, you will establish commercially reasonable security procedures and controls to limit access to your password or other identifying information to authorized individuals.

We may provide links to third-party websites, and some of the content appearing to be on this Site is in fact supplied, supported, or provided directly or indirectly by third parties, for example, in instances of framing of third-party websites or incorporation through frame sets of content supplied by third-party servers. If you choose to link to a Website not controlled by BPI Calc , then BPI Calc does not make warranties, either expressed or implied, concerning the content of such Websites, including the accuracy, completeness, reliability, or suitability thereof for any particular purpose, nor does BPI Calc warrant that such Websites or content are free from any claims of copyright, trademark, or other infringement of the rights of third parties, or that such Websites or content are devoid of viruses or other contamination.

Payments
We accept the Stripe payment methods on the service. When you provide us with your payment information, you authorize our use of and access to the payment instrument. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.
If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
Cancellation, Refund & Subscription Suspension Policy
Upon purchase of an annual subscription, you acknowledge that BPI Calc has a no refund policy with respect to all subscription payments.
Each subscriber acknowledges that their subscription is for their singular use only. BPI Calc reserves the right to cancel access to those subscribers who
(a) willingly share their website access across multiple persons,
(b) reproduce, copy or in any way release website material/s without written permission from BPI Calc and/or
(c) attempt to create more than one free trial.
Data Storage and Security
This clause is intended to clearly inform you that all your data, including but not limited to personal information, usage records, uploaded content, etc., will be stored on cloud servers located in Australia. The server strictly complies with relevant Australian and international laws and regulations to ensure data security and compliance.
We have taken all reasonable and necessary measures, including but not limited to data encryption, access control, periodic audits, etc., to protect the data stored on the Australian cloud server from unauthorized access, use, disclosure, destruction, loss, or tampering.
Limitation of Liability
The CM Group and its affiliates will not be liable for damages caused by computer viruses, trojans, or other malicious programs, as well as hacker attacks; failures in the computer software, systems, hardware, or communication lines of the user or CM Group; improper user operations or the use of this service through unauthorized means not approved by CM Group; outdated software versions, aging equipment, and/or compatibility issues; and other circumstances beyond the control or reasonable foresight of CM Group.
Applicable Law
These Terms and Conditions shall be governed in all respects by the substantive laws of Victoria, Australia. Any controversy, claim, or dispute arising out of or relating to these Terms and Conditions shall be subject to The Supreme Court of Victoria, Australia.
Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
Modification to terms of service
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate BPI Calc and the way we expect users to behave on BPI Calc. We will notify users by post a notice on BPI Calc. Continued use and browsing of the service after such changes shall constitute your consent to such changes.
Indemnification
You agree that the CM Group, and any subsidiaries, officers, employees or third-party contractors cannot be held responsible for any third-party claim, demand or damages, including reasonable attorneys’ fees, arising out of your use of the service.

Our explains the way we handle and protect your personal data in relation to your use and browsing of BPI Calc. By agreeing to the present Terms and Conditions and to be able to use the Service, you also agree to our Privacy Policy.
